A 37-year-old man will face a Sydney court for an assault charge after yesterday's 12-hour stand-off with police on a roof near where his girlfriend was found dead.

Mr Seo appeared distressed and at times dangled his legs off the high balcony.

At about 7.20pm, more than 12 hours later, officers attached to the NSW Police Rescue and Bomb Disposal Unit arrested the man, who is believed to be in his 30s.

Court documents allege Mr Seo assaulted his partner occasioning actual bodily harm about 4:30am on Monday in Chatswood in a domestic violence-related incident.

Police have said they can not remove the victim's body and secure the crime scene while the man is still on the awning.

"Potentially by then there may or may not be further charges I gather", magistrate Daniel Reiss said.
